Terms of Use

1. Agreement

These terms are an agreement between you and LoShe (“LoShe”, “we”, “us”). They apply when you visit loshe.in, register a shop, use the shop dashboard at store-admin.loshe.in, or join a shop's rewards page. By using LoShe you accept these terms. If you don't accept them, please don't use LoShe.

If you register a shop, you confirm that you are at least 18 years old and that you have the authority to accept these terms on behalf of the shop or business. Our Privacy Policy explains how we handle personal information and forms part of these terms.

2. The service

LoShe lets a shop run a loyalty programme. A shop gets its own page and QR code, and its customers can join, claim visits, and earn and redeem the rewards that the shop sets. The shop gets a dashboard to manage its customers, rewards, offers and claims.

We keep improving LoShe, so features may change, be added or be removed. If we make a change that materially reduces what a paying shop receives, we will tell the shop first.

3. Your account

• Give us accurate information when you register, and keep it up to date.
• Keep your password secret. You are responsible for everything done through your account, including by staff you give access to.
• Tell us straight away if you think someone has used your account without permission.
• Each registration is for one shop business. It may have several branches.

4. Free trial, fees and payment

• Free trial. A new shop starts with a free trial, for the length shown when you register. You don't need to pay to try LoShe.
• Subscription. After the trial, LoShe is a paid subscription. The price is shown on our pricing section; at the time of writing it is ₹599 a year, with GST included. The fee is paid in advance for the period you buy.
• How you pay. For now, subscriptions are arranged with us directly: call or WhatsApp us on +91 91095 36835. Unless we tell you otherwise, we do not charge you automatically, and we will remind you before your subscription ends.
• Price changes. We may change our prices for future periods. A change never affects a period you have already paid for.
• Refunds. Fees are not refundable, except where the law requires it or where we agree otherwise in writing.
• If your subscription ends. After a short grace period we may limit access to your dashboard, and take your shop page offline, until you renew.

5. Your customers’ information

When customers join your shop's page, you collect their names and phone numbers through LoShe. That information belongs to your shop, and you are responsible for using it properly. In particular, you agree that you will:

• use it only to run your loyalty programme and to talk to your customers about your shop, and not to sell it or pass it to others;
• follow the laws that apply to you, including India's Digital Personal Data Protection Act, 2023 and the rules on unsolicited commercial messages, and WhatsApp's own terms and policies;
• not send spam or messages people have not agreed to receive, and stop when someone asks you to; and
• keep it secure, including by keeping your staff's access to your dashboard under control.

You allow us to store and process that information on your behalf, only in order to provide LoShe to you. Our Privacy Policy explains how we do so.

6. Acceptable use

Please use LoShe fairly. You must not:

• break the law, or use LoShe for anything unlawful, misleading or harmful;
• upload content that is unlawful, defamatory, hateful, or that infringes someone else's rights;
• offer rewards that depend on someone leaving a positive review, or otherwise break the rules of Google, Instagram or any other platform you link to. The Google review button on a shop page is for honest reviews, and rewards must not depend on them;
• create fake customers, claims or visits, or try to earn rewards dishonestly;
• try to break, overload or get around the security of LoShe, or access another shop's information;
• copy, scrape, resell or reverse-engineer LoShe, except as the law allows; or
• use LoShe to send spam.

7. Your content

You keep ownership of what you put into LoShe, such as your shop's name, logo, photos, offers and rewards. You give us permission to store, display and use that content only to run LoShe for you, including showing it on your shop page. You promise that you have the right to use what you upload.

8. Rewards are the shop’s promise

Each shop decides its own rewards and offers, decides whether a claim or receipt is approved, and is responsible for giving the rewards it promises. LoShe provides the tools, but is not a party to the arrangement between a shop and its customers, and is not responsible for a shop's rewards, offers or decisions. If you are a customer and have a problem with a reward, please speak to the shop.

9. Our property

LoShe, its software, design, name and logo belong to us. While you are using LoShe in line with these terms, we give you a limited right to use it for your shop. This does not give you ownership of anything of ours. If you give us feedback or ideas, we may use them without owing you anything.

10. Availability

We work to keep LoShe running, but we cannot promise that it will always be available or free of errors. It may occasionally be unavailable for maintenance, or for reasons outside our control.

11. Ending your use of LoShe

You can stop using LoShe at any time. If you would like your shop's information deleted, or a copy of your customer list, contact us before you go.

We may suspend or end your access if you break these terms, if your use puts LoShe or other people at risk, or if the law requires it. Where we reasonably can, we will tell you why first. Sections that by their nature should continue afterwards, such as those on ownership, liability and the governing law, do continue.

12. No guarantees

LoShe is provided “as is” and “as available”. We do not promise any particular result, such as more customers, reviews, followers or sales, and to the fullest extent the law allows we do not give any warranties beyond those in these terms.

13. Limit on our liability

To the fullest extent the law allows, LoShe is not liable for any indirect or consequential loss, or for lost profits, revenue, data or goodwill. Our total liability to you for anything arising from your use of LoShe is limited to the fees you paid us in the 12 months before the event that gave rise to the claim.

Nothing in these terms limits any liability that cannot be limited by law.

14. If a claim is made against us

You agree to cover us for claims, losses and reasonable costs that arise from your content, from how you use your customers' information, or from your breach of these terms or of the law.

15. Governing law

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at the place of our registered office in India. We would always rather sort a problem out with you first, so please talk to us before taking it further.

16. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. If a change is significant, we will tell shop users in the dashboard or by message. If you keep using LoShe after a change takes effect, you accept the new terms.

17. General

• These terms and our Privacy Policy are the whole agreement between you and us about LoShe.
• If part of these terms is found to be unenforceable, the rest still applies.
• If we don't enforce a term straight away, we haven't given it up.
• You may not transfer your rights under these terms to anyone else without our written consent. We may transfer ours as part of a merger or sale of the business.
• We may contact you about LoShe in the dashboard, or by phone, WhatsApp or email.
